Terms of Service

Welcome to Fluo, a language learning application that helps users learn Chinese through AI-powered practice sentences, translations, and spaced repetition. These Terms of Service ("Terms") govern your access to and use of the Fluo mobile application and related services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Fluo, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.
You must be at least 13 years of age to use Fluo. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. License
Subject to your compliance with these Terms, Fluo grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the application on devices that you own or control, solely for your personal, non-commercial educational purposes.
You may not:
- Copy, modify, or create derivative works of the application or its content.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application.
- Distribute, sublicense, lease, lend, or rent the application to any third party.
- Make the application available over a network where it could be used by multiple devices or users at the same time.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the application.
This license terminates automatically if you violate any of these Terms. Upon termination, you must cease all use of the application and delete all copies from your devices.
3. AI-Powered Features
Fluo offers AI-powered features including personalized sentence generation, translations, and an AI tutor. These features are provided by Google's Gemini AI service. By opting in to AI features, you acknowledge that:
- Your vocabulary progress and learning data may be sent to Google Gemini to generate personalized content.
- Text you submit for translation is processed by Gemini to provide translations.
- Questions you ask the AI tutor are processed by Gemini to provide answers.
- Your name, email, and account credentials are never sent to the AI service.
You may opt in or out of AI features at any time through the app's Profile settings. Without AI features enabled, you can still practice with Fluo's existing sentence library.
AI-generated content (sentences, translations, and tutor responses) is provided for educational purposes only. Fluo does not guarantee the accuracy or completeness of AI-generated content.
4. Subscriptions & Payments
Fluo offers a free tier and a premium subscription ("Fluo Premium"). Subscriptions are billed through the platform's in-app purchase system (e.g., Apple App Store, Google Play). By subscribing, you agree to the applicable platform's payment terms, including:
- Payment is charged to your account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your device's account settings.
5. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by Fluo or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Fluo is solely responsible for addressing any claims by you or any third party relating to intellectual property infringement by the application or your use of it.
6. User Conduct
When using Fluo, you agree to:
- Use the Service only for its intended educational purpose.
- Not abuse, harass, threaten, or intimidate other users.
- Not send spam or unsolicited messages through the Service.
- Not attempt to gain unauthorized access to the Service, other users' accounts, or any systems or networks connected to the Service.
- Not use automated tools, bots, or scripts to access the Service without our written permission.
- Not interfere with or disrupt the Service or its infrastructure.
- Comply with all applicable local, national, and international laws and regulations.
7. Third-Party Services
The Service may access or rely on third-party services, content, or resources (including AI providers, analytics, and authentication services). These third-party services are subject to their own terms and conditions. Fluo is not responsible for the availability, accuracy, or content of any third-party services, and your use of them is at your sole risk.
You must comply with any applicable third-party terms of agreement when using the application, including the terms of your wireless data service agreement.
8. Data Collection
Fluo may collect and use technical data and related information — including but not limited to device identifiers, operating system version, and app usage data — to facilitate software updates, product support, and service improvements. This data is collected in a form that does not personally identify you. Our full data practices are described in our Privacy Policy.
9. Maintenance and Support
Fluo is solely responsible for providing maintenance and support for the application. You may contact us at the address listed below for any support requests. Platform providers (such as Apple or Google) have no obligation to furnish any maintenance or support services with respect to the application.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FLUO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Fluo does not guarantee the accuracy, completeness, or reliability of any translations, AI-generated sentences, or other language learning content generated by the Service. Such content is provided for educational purposes only and should not be relied upon as a sole source of language instruction.
In the event the application fails to conform to any applicable warranty, you may notify the applicable platform provider (e.g., Apple), and they may refund the purchase price (if any) for the application. To the maximum extent permitted by applicable law, the platform provider has no other warranty obligation with respect to the application. All other warranty claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Fluo's sole responsibility.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLUO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF FLUO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FLUO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO FLUO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
12. Product Claims
Fluo is solely responsible for addressing any claims relating to the application or your possession and use of it, including but not limited to: (a) product liability claims; (b) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
13. Export Compliance
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree not to use or export the application except as authorized by United States law and the laws of the jurisdiction in which the application was obtained.
14. Termination
Fluo reserves the right, at its sole discretion and without prior notice, to:
- Remove, disable, or restrict access to any content that violates these Terms or that we otherwise find objectionable.
- Suspend or terminate your account and license for any reason, including but not limited to violations of these Terms.
- Modify or discontinue the Service (or any part of it) at any time.
Your license to use the application terminates automatically upon any violation of these Terms. Upon termination, you must cease all use of the application and destroy all copies in your possession.
15. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date at the top of this page. If the changes are material, we will notify you through the app or by email. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
17. Apple App Store Additional Terms
If you downloaded or purchased the application from the Apple App Store, the following additional terms apply:
- These Terms are between you and Fluo only, not with Apple Inc. ("Apple"). Apple is not responsible for the application or its content.
- Your license to use the application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.
- Apple is not responsible for addressing any claims by you or any third party relating to the application or your possession and use of it, including but not limited to product liability claims, any claim that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the application or your possession and use of it infringes that third party's intellectual property rights, Fluo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
